1. General provisions.
1.1. These rules for the purchase and sale of goods (hereinafter referred to as the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the e-shop.
1.2. The Seller reserves the right to change, amend or supplement the rules at any time, taking into account the requirements established by law. The Buyer is informed on the e-shop website. When the Buyer makes purchases in the e-shop, the Rules in force at the time of placing the order apply.
1.3. The following individuals have the right to buy in the e-shop:
1.3.1. legally competent individuals, i.e. persons who have reached the age of majority, whose legal capacity is not restricted by court order;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above-mentioned persons.
1.4. By confirming the rules, the Seller also guarantees that, in accordance with clause 1.3. of the rules, the Buyer has the right to purchase goods in the e-shop.
1.5. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having created a shopping cart in the e-shop, specified a delivery address, selected a payment method and familiarized himself with the Seller’s rules, clicks the “Confirm order” button (see clause 5 “Ordering goods, prices, payment procedure, terms”).
2. Personal data protection.
2.1. When ordering goods in the e-shop www.industris.lt, the Buyer must provide the data requested during the purchase: name, surname, address and e-mail address.
2.2. The Buyer is responsible for providing correct data during the purchase.
2.3. By placing an order, the Buyer agrees that the personal data provided by him will be processed for the purposes of executing the order. The Buyer also agrees that information messages necessary for the execution of the order of goods will be sent to the e-mail address specified by the Buyer.
2.4. The Buyer’s personal data may be processed for marketing purposes only if the Buyer expresses his consent to this.
2.5. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except when required by a competent State institution in cases provided for by the laws of the Republic of Lithuania or with the separate written consent of the Buyer.
3. Buyer’s rights and obligations.
3.1. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and to accept them.
3.2. Provide complete, detailed and correct information in the payment form. If the Buyer provides inaccurate, false or misleading data in the payment form, www.industris.lt has the right to cancel the Buyer’s registration and delete the data.
3.3. The Buyer has the right to withdraw from the contract of purchase and sale of goods, in accordance with the provisions set out in the Rules for Returning Goods.
3.4. If the data provided in the Buyer’s registration form changes, the Buyer must immediately inform the Seller.
3.5. The Buyer undertakes not to transfer his login data to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this by the means of communication specified in the “Contacts” section.
3.6. By using the e-store, the Buyer agrees to these Rules of Purchase and Sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
4. Rights and obligations of the Seller.
4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the e-store.
4.2. If the Buyer tries to harm the stability and security of the Seller’s e-store or violates its obligations, the Seller has the right to immediately and without warning limit or suspend the Buyer’s ability to use the e-store or, in exceptional cases, cancel the Buyer’s registration.
4.3. The Seller undertakes to respect the Buyer’s right to privacy to the Buyer’s personal information specified in the e-store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering goods, prices, payment procedure, terms.
5.1. The Buyer can shop online in the e-store 7 days a week, 24 hours a day.
5.2. Orders are accepted only using the e-store www.industris.lt.
5.3. All prices of goods in the online store are indicated in euros, including VAT.
5.4. The Buyer undertakes to pay for the order within 3 (three) calendar days from the date of order confirmation. The shipment begins to be prepared only after receiving payment for the goods.
5.5. If the Buyer fails to make the payment within 3 (three) calendar days, the order is canceled.
5.6. Payment can be made using the electronic banking services of Swed, Seb, Luminor banks and Visa/Mastercard credit cards. Payments are possible in euros. Payments are processed using the MakeCommerce.lt payment platform.
6. Delivery of goods.
6.1. The Buyer undertakes to indicate the exact place of delivery of the goods.
6.2. The Buyer undertakes to accept the goods himself. In the event that the Buyer cannot accept the goods himself, and the goods are delivered to the specified address, the Buyer does not have the right to make claims to the Seller regarding the delivery of the goods to an inappropriate entity.
6.3. The goods are sent to the Buyer within 2 business days (if we have the goods in stock) from the confirmation of payment.
6.4. In all cases, the Seller is exempted from liability for failure to meet the delivery deadlines if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the Seller’s control.
6.5. The Buyer must immediately inform the Seller if the shipment is received in damaged packaging, if the shipment contains unordered goods or an incorrect quantity, or an incomplete set of goods.
6.6. The Buyer must e-mail the Seller photos of the damaged parcel and/or product(s)
7. Quality of goods, guarantees.
7.1. The data of each product sold in the e-shop are generally indicated in the product description for each product.
7.2. The Seller is not responsible for the fact that the color, shape or other parameters of the products in the e-shop may not correspond to the actual size, shape and color of the products due to the characteristics of the display used by the Buyer.
7.3. The Seller provides a quality guarantee valid for a certain period of time for certain types of products, the specific term and other conditions of which are indicated in the descriptions of such products.
8. Marketing and information.
8.1. The Seller may initiate various promotions in the e-shop at its discretion.
8.2. The Seller has the right to unilaterally, without separate notice, change the terms of the promotions, as well as cancel them. Any change or cancellation of the terms and conditions of the promotion shall be valid only in the future, i.e. from the moment of their execution.
8.3. The Seller shall send all notifications by the means of communication specified in the Buyer’s registration form.
8.4. The Buyer shall send all notifications and questions to the telephone numbers and e-mail addresses specified in the Seller’s e-store section “Contacts”.
8.5. The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to malfunctions in the Internet connection, e-mail service provider networks, messages falling into the SPAM directory, or due to incorrect data provided by the Buyer.
8.6. The Buyer’s personal data may be processed for marketing purposes under the conditions specified in paragraph 2.4 of these Rules.
9. Final provisions.
9.1. These Rules for the purchase and sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
9.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
